Job Title: Judicial Law Clerk (2026-2027 Term)

Judge Benjamin is hiring 2 law clerks for the 2026-2027 term.

Please note that post-law school legal work experience is required. Prior judicial clerkship experience is preferred. 

The clerkship is based in Columbia, South Carolina. Oral arguments are held in Richmond, Virginia, at least six times per year; travel is required to each oral argument sitting. The clerkship is research and writing-intensive. Clerks are required to write bench memos, draft opinions, ensure accurate citations, and collaborate effectively with other clerks.

A prior judicial clerkship is strongly preferred. Demonstrated legal writing of the highest quality is required. Standing within the upper one-third of the class of an approved law school on the list of either the American Bar Association or the Association of American Law Schools is required. Demonstrated proficiency in legal studies is required. Examples may include one or more of the following:

• Experience on the editorial board of a legal journal or law review;
• Publication of a noteworthy article in a law school student publication or other
scholarly publication;
• Special high-level honors for academic excellence in law school, such as election
to the Order of the Coif;
• Membership and participation with a moot court or mock trial team that
represents the law school in competition with other law schools.

This list is not all-inclusive, and applications will be considered holistically. Applicants are required to submit an application through OSCAR that includes the following items:

• Cover letter;
• Resume;
• Undergraduate, law school, and postgraduate (if applicable) grade sheets or
transcripts;
• Writing sample that does not exceed 15 pages. Permissible writing samples
include: a litigation-oriented document such as a brief or memo, a law review
note or article, or a solo-drafted opinion;
• Three letters of recommendation.
